1) иск против сознавшегося в своей вине, rei aestimandae causa (l. 23 § 11. 1. 25 § 1. 2 D. 9, 2). 2) вещный иск (arbitraria actio), поср. которого имеющий сервитут вынуждает всякого к признанию его права (1. 2. 4 § 2. 5. D. 8, 5).
